The consequences for possession of cannabis vary, depending upon the amount in question. Under the Illinois Drug Paraphernalia Act, there is a statutory minimum fine of $750 for possession of paraphernalia.

Individuals who have been charged for the first time are often eligible to participate in a diversion program, depending upon the county in which the offense occurs. Diversion programs are created for those who have never been involved in the criminal justice system. Once the diversion program is satisfactorily completed, your charges will be dismissed by the court and the arrest will be expunged from your record.

For more serious drug offenses, most counties have drug court programs for those who are true addicts. If your criminal conduct is directly related to your addiction and you participate successfully, the underlying felony charges will be dismissed at the end of the program.

The DeKalb County Drug Court: The C.L.E.A.N. Program provides non-violent substance abusing offenders with the opportunity to receive treatment for their addictions, in exchange for avoiding jail time and having their charges reduced or dismissed.
